The terms and conditions set out below are important as they govern the terms upon which you will be a customer of Amanda’s Wines and upon which Amanda’s Wines will supply any wine ordered by you or on your behalf through www.amandaswines.co.uk . No other terms and conditions shall apply in respect of the purchase of such wine unless expressly accepted in writing by Amanda’s Wines. You should understand that by ordering wine from us you agree to be bound by these terms and conditions.

You should print a copy of these terms and conditions for your future reference.

ORDER PROCESS

Once you have placed an order with us, you will receive an acknowledgement email setting out the products you have ordered to the email address you provide to us. This acknowledgement email is not an acceptance of your order by Amanda’s Wines. Your order constitutes an offer to us to buy wines from us and is subject to acceptance by Amanda’s Wines. There will be no contract between you and Amanda’s Wines until we accept your offer by sending to you a Dispatch Confirmation by email to the email address you provide to us, at this point there will be a legally binding contract between us in relation to the wine detailed in the Dispatch Confirmation.

WINE QUALITY AND TASTE

We hope that drinking our wines will be an enjoyable experience. If you are dissatisfied with the wine you have received or it is received in an unsatisfactory condition please contact us on 0033 254 44 1162. Whilst we make every effort to ensure the proper cellaring of wines in our possession and act in good faith in purchasing wines, we cannot be responsible for the condition of any wines which have deteriorated due to their age or the conditions in which they have been stored.

We try to describe all wines as accurately as possible however taste and preference is personal and we therefore cannot be responsible for any wines that do not accord with their description.

OWNERSHIP

Legal ownership to all wine shall remain with Amanda’s Wines until payment in full has been received for the wine and any other sums owed to Amanda’s Wines (whether or not then due and whether or not owing in respect of the wine supplied). Once the wines have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

PAYMENT

Payment is due with the order unless otherwise agreed by us. We accept payment by MasterCard, Visa, Delta, UK Maestro.

PRICES

All prices for the wines that you order are as set out in our website at the time of ordering (except in cases of obvious error) and are per standard case (12 bottles of 75cl) in sterling inclusive of UK duty and VAT.

Our site contains a large number of wines and it is always possible that, despite our best efforts, some of the wines listed on our site may be incorrectly priced. We will normally verify prices as part of our dispatch procedures so that, where a wine’s correct price is less than our stated price, we will charge the lower amount when dispatching the wine to you. If a wine´s correct price is higher than the price stated on our site, we will normally, at our discretion, either contact you for instructions before dispatching the wine, or reject your order and notify you of such rejection.

We are under no obligation to provide the wine to you at the incorrect (lower) price, even after we have sent you a Dispatch Confirmation, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mis-pricing.

MINIMUM ORDERS

The minimum order is 1 standard case (12 bottles of 75cl).

DELIVERIES AND IMPORT DUTY

Delivery to mainland England is free of charge for all individual orders of 12 bottles or more. For all other orders a charge of £12 incl. VAT is levied on any order for delivery to mainland England. Charges for Scotland and Wales, and other UK destinations are available upon request.

Collection from our cellar depot is free of charge. You must provide the name of the person collecting the wine and they must show proof of identity. If these conditions are not satisfied we will not permit the wines to be collected.

Deliveries are normally made between 9.00am and 5.00pm, Monday to Friday and will be to the address you give us for delivery at the time you place your order.

Amanda’s Wines will make every reasonable effort to comply with your delivery instructions but is unable to agree to a definite delivery schedule. We will endeavour to complete delivery with 5 working days of the date we receive your order, if we are unable to do so we will contact you and give you an estimate of the delivery date. If the estimated delivery date is more than 30 days after the date we received your order we will give you the option to cancel your order.

If the wines we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 5 working days of the delivery of the goods in question.

Our prices are inclusive of UK duty and VAT however you must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase wines from our site. The importation or exportation of wines may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the wines you purchase.

CANCELLATION

If you are contracting as a consumer you may cancel your order for any reason whatsoever up to the end of the fourteenth calendar day from the date you receive the ordered goods provided all the bottles are unopened and intact. You do not need to give us any reason for cancelling your order nor will you have to pay any penalty.

If you cancel your order and have received the wines from us or you receive them after your cancellation (if we have already processed the wines for delivery when you cancel the contract) then you must return the wines to us at our contact address at your own cost and risk as soon as possible. You have a legal obligation to take reasonable care of all wines whilst they are in your possession. If you fail to comply with this obligation we may have a right of action against you for compensation.

Once you have notified us that you are cancelling your order, any sum debited to us from your credit or debit card will be re-credited to your account as soon as possible and in any event within 30 days of the day you have given notice of your cancellation. If you do not return the wines delivered to you or do not pay the costs of delivery to us, we shall be entitled to deduct the direct costs of recovering the wines from the amount to be re-credited to you.

GENERAL

These offers are only available to persons aged 18 or over. Under the Licensing Act of 1964 it is an offence for an individual aged under 18 to buy or attempt to buy intoxicating drinks. By placing an order you confirm that you are at least 18 years old and are legally capable of entering into binding contracts.

No variation or waiver of any of these conditions shall be binding on Amanda’s Wines unless in writing signed by a director of Amanda’s Wines.

Save as precluded by law, Amanda’s Wines will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this these terms and condition and we shall have no liability to pay any money to you by way of compensation.

Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to limit any liability that under any statute we may not exclude.

Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

All notices given by you to us must be given to Loire Valley Wine Limited at Domaine du Prieuré, 41120 Valaire, France or by email to amanda@amandaswines.co.uk. We may give notice to you at either the e-mail or postal address you provide to us when placing an order, or in any of the ways specified above. Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was sent by registered or recorded delivery and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.

We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these terms and conditions will not be affected.

You acknowledge and agree to be bound by the terms of our privacy policy.

Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the wines to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any wines offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

These Terms & conditions shall be governed by and construed in accordance with English law and you and we irrevocably submit to the exclusive jurisdiction of the English courts to determine any disputes which may arise in connection with them.
